Terms and Conditions – Watch and Pendent
Guardiant relies on location information, such as GPS as well as 3rd party telecommunication networks and depends on your Device’s ability to acquire a GPS satellite, (typically not available indoors) a WiFi signal or network coverage. Network coverage and WiFi and satellite signals are dependent on a number of factors outside the control of Guardiant including weather, topographical changes, the presence of obstructions such as tall buildings, the functionality of various satellites, cell towers, clouds, and other factors. GPS location readings are inherently subject to “drift” which can affect accuracy in varying increments. Guardiant App (Guardiant) collects your unique user identifier and precise or approximate location information as determined through data such as GPS and WiFi positioning. During the following scenario’s location information cannot be sent to our servers: no coverage, no data service on the SIM in the device, if you turn the device off or the battery goes flat. Users of the Guardiant app will receive alert notifications regarding your activity when you arrive or leave assigned location points and when the SOS is activated. In delivering our services, we may use your Personal Information to assist with our technical and/or customer support (for example we may use your Personal Information to verify identity, assist with identification of users, and to determine appropriate services) or to allow us to perform diagnostics on your device including historical and tracking record reports to analyse the performance of your device. You understand and expressly limit and agree to hold harmless Guardiant, its officers and employees in relation to any and all harms that result from the Device or Services not working, malfunctioning, or failing due to any of these factors. You also understand that our monitoring platforms rely on hosting services which may be unavailable at some point during the year due to maintenance, or other outages. We offer a Refund & Warranty Policy for Merchandise purchased. If for any reason you are not satisfied with merchandise purchased from our website we offer a 14 day money-back guarantee from the time you receive the goods. We also offer a 12 month Manufacturers Warranty on the watch and Pendant. Our refund & warranty policies do not apply to goods which have been damaged after delivery, or if any attempt has been made to alter the product or if they have been dropped or broken. A protective screen cover is provided and encouraged by Guardiant, as broken and cracked LCD screens are not covered under warranty and cannot be repaired. Straps, buckles and latches broken during normal use are not covered under warranty however we offer replacement parts that may be purchased separately from our spare parts page. If you choose a Guardiant SIM plan it includes a specified number of SMS alerts or voice minutes each month, additional SMS alerts or voice minutes will be charged at a rate of $0.25c per SMS or minute and will be billed in the month following the usage. The SIM card supplied in your Guardiant watch is configured to work in Guardiant watches only. Removing the SIM from the watch and attempting to use it in another device will result in your service being cancelled and the SIM service deactivated. Guardiant is configured for operation within Australia if you travel outside the country an International Roaming plan will need to be purchased to continue its use overseas. If you have chosen a BYO SIM plan this plan provides you with access to and support for the Guardiant monitoring platform and Apps but does not include an active SIM card or SIM plan. For your Guardiant watch to function correctly you agree it is your responsibility to maintain an active SIM plan with data, SMS and voice capability. Any questions or issues in relation to the SIM or network coverage are the responsibility of the customer. Terms and Conditions – International Roaming
I understand that if I have voice enabled on my SIM while traveling overseas any calls to or from the watch or SOS alerts activated from the watch will be deducted from the allocated SMS alerts or voice minutes for the month. I also agree that any additional SMS alerts or voice minutes will be charged at $1.00 per SMS/Minute. I understand that while travelling overseas Guardiant has no control over the 3rd party cellular networks that the device connects to and cannot guarantee connectivity at all times.
Terms and Conditions – Loan Watch
Guardiant is supplying you with one (1) loan watch for your use during the period that your current watch is undergoing testing. This agreement is only offered when a customer requires a watch during the period that their current watch is undergoing testing and is supplied for short term use only. In most circumstances the loan watch is not a brand-new watch and has been used previously. The loan watch is offered at a hire charge of $30 to the customer. This includes the set-up of the loan watch, the postage for loan watch to be sent and a paid return satchel to return your loan watch once you have received your current watch back. It is the customers responsibility to ensure that the watch is not damaged during the hire period. The watch must be returned in good working order with all accessories within 21 days of receiving the repaired or replacement watch. If the loan watch is not returned within the 21 day period or if the watch is returned damaged, the customer will be held liable and required to pay a fee of $180.00. In the circumstance where the customer does not pay the late and or damage fee their account will be suspended until such time that the fee has been paid in full or the watch is returned. The customer must agree to these terms and conditions. Your current subscription will cover the subscription usage on the loan watch. Once the $30 hire charge has been processes and received, a loan watch will then be activated under your account and dispatched via Express Post within 1 working day of receiving confirmation.
